The contaminated site program of the Canton of Zurich and cost distribution

The Cantonal Department of Waste, Water, Energy and Clean Air (AWEL) recently issued its intermediate report about the contaminated site program for the Canton of Zurich. This contains a number of interesting points about the implementation of the contaminated site laws in this canton, which has a total of 5 740 entries in the land register.

This report also mentions that the number of AWEL-decided cost distributions has increased sharply in recent years. This arrangement concerns proceedings in which the regular high costs of investigations and remediation measures are distributed among the polluters involved. These proceedings are often costly and long-term as complex clarifications of the facts are required, some of which date back many years and for which there is often no documentation available. Moreover, there are also sometimes complex legal issues for which there are few or no legal precedents.
